Dividing Military Retired Pay & Survivor Benefits
The Uniformed Services Former Spouses’ Protection Act allows state courts to treat military retired pay as divisible property, but it doesn’t automatically award a former spouse a specific share. The court order, marriage dates, service history, and jurisdiction can all affect the analysis.
The 10/10 rule concerns whether the Defense Finance and Accounting Service, commonly called DFAS, can make direct property-division payments to a former spouse. It doesn’t determine whether a California court may award part of the retired pay. Orders submitted to DFAS must also contain language clear enough for the agency to calculate and process the division.
Survivor Benefit Plan coverage may require separate provisions in the divorce judgment. Federal filing requirements and deadlines apply to former-spouse elections and deemed elections, so the judgment should address coverage directly rather than assume it follows the retirement award.
How Deployment Can Affect Custody & Court Proceedings
California Family Code section 3047 addresses custody and visitation when military duty materially affects a parent’s ability to exercise parenting time. Deployment, activation, relocation, or temporary duty isn’t automatically grounds for a permanent custody change.
A parenting plan for a military family may need to address:
- Communication between the deployed parent and children
- Travel arrangements and transportation costs
- Holiday schedules and make-up parenting time
- Temporary absences and future duty-station changes
- Procedures for reviewing temporary custody arrangements
The Servicemembers Civil Relief Act provides certain protections when military service materially affects a service member’s ability to participate in a civil case. The service member may request a stay, or temporary pause, when the applicable requirements are met. This protection isn’t automatic in every case.

A financial review may cover base pay, allowances, retirement benefits, disability-related compensation, Thrift Savings Plan assets, and other property interests. California community property rules generally require identifying the marital portion of each asset rather than treating every military-related payment the same way.

- Child support: Income records, parenting arrangements, and California support rules affect the calculation.
- Spousal support: The parties’ finances, marriage history, and applicable statutory factors may influence temporary or long-term orders.
- Property division: Retirement accounts, personal property, debts, and military benefits may receive different treatment.
- Jurisdiction: A service member’s residence, domicile, assignment, and connection to California can affect the court’s authority over retired pay.
